Welcome to LMH-9 (Lunar Matrix Hosting 9). These Terms of Service ("Terms") govern your use of our website, products, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

LMH-9 is operated by LMH Sembilan Sdn Bhd (202201016723), a company registered in Malaysia with its registered office at Level 7, Jalan PJU 1A/7A, Oasis Wing, Brunsfield Oasis Tower, Ara Damansara, 47301 Petaling Jaya, Selangor.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our Services after any changes indicates your acceptance of the modified Terms.

2. Services

LMH-9 provides web hosting, web design, server solutions, and digital marketing services. The specific features and limitations of each service are described on our website and in your service agreement.

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of our Services.

3. Account Registration and Security

To use certain Services, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and confidential
Notify us immediately of any unauthorized use of your account
Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or no longer current.

4. Payment Terms

Fees for our Services are described on our website or in your service agreement. All fees are in Malaysian Ringgit (RM) unless otherwise stated.

You agree to pay all fees associated with your selected Services. Payments are due in advance and may be recurring depending on your subscription plan. By providing your payment information, you authorize us to charge the applicable fees to your payment method.

If we are unable to process your payment, we may suspend or terminate your access to the Services. You are responsible for all taxes associated with your use of our Services.

5. Refund Policy

Our refund policy varies by service:

Shared Hosting: 30-day money-back guarantee for new accounts
VPS and Dedicated Servers: 7-day money-back guarantee for new accounts
Domain Registration: Non-refundable
SSL Certificates: Non-refundable once issued
Custom Development Services: As specified in your service agreement

Refunds are processed to the original payment method. Setup fees, domain registration fees, and SSL certificate fees are non-refundable.

6. Service Level Agreement (SLA)

We strive to maintain 99.9% uptime for our hosting services. In the event of service unavailability, we may provide service credits as described in our Service Level Agreement.

Scheduled maintenance does not count as service unavailability. We will make reasonable efforts to notify you in advance of scheduled maintenance.

7. Acceptable Use Policy

You agree not to use our Services to:

Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Distribute malware, viruses, or any other malicious code
Engage in unauthorized access to any system, network, or account
Conduct activities that interfere with or disrupt our Services or servers
Harvest or collect email addresses or other contact information
Send unsolicited emails or engage in spamming activities
Impersonate any person or entity

We reserve the right to suspend or terminate your access to our Services if we determine, in our sole discretion, that you have violated our Acceptable Use Policy.

8. Content and Intellectual Property

You retain all ownership rights to your content. By uploading content to our servers, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for the purpose of providing our Services to you.

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use your content as necessary to provide our Services.

All intellectual property rights in our Services, including but not limited to software, logos, trademarks, and documentation, are owned by LMH-9 or our licensors. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

9. Limitation of Liability

To the maximum extent permitted by law, LMH-9 and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with these Terms or your use of our Services.

In no event shall our aggregate liability for all claims relating to these Terms or our Services exceed the amount paid by you to LMH-9 for the Services during the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, so some of the above limitations may not apply to you.

10. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

You may terminate your account at any time by contacting our customer support. Upon termination, your right to use our Services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Privacy Policy

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you. By using our Services, you consent to our collection, use, and disclosure of information as described in our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

13. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and LMH-9 regarding our Services and supersede all prior agreements and understandings.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without your consent.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
